UN war crimes court says ultra-nationalists can’t be tried in Serbia

A UN war crimes court has rejected a request to transfer a contempt of court case to the Serbian judiciary because of fears that the ultra-nationalists under indictment could intimidate or otherwise influence witnesses, a ruling issued on Tuesday said.

Serbian Radical Party (SRS) officials Vjerica Radeta and Petar Jojic were indicted for using intimidation and bribery to influence witnesses in the war crimes case against their party leader Vojislav Seselj before the Hague Tribunal (ICTY).  

The ruling said that the judges at the International Residual Mechanism for Criminal Tribunals, which took over from the ICTY decided to overturn a June 2018 decision to turn the case over to the Serbian judiciary because witnesses are unwilling to appear before courts in Serbia, fearing for their safety. The judges ruled that the witnesses’ evidence is paramount to the prosecution’s case.  

“The conditions for the referral of this case to Serbia are not met,” the ruling said.  

The judges revoked the earlier referral order and arrest warrants and issued new international arrest warrants for Jojic and Radeta. They also called the Serbian authorities to transfer the two accused to the seat of the Mechanism in the Hague without delay.
