Chief Prosecutor of the Higher Public Prosecutor’s Office in Belgrade Nenad Stefanovic said that, from the standpoint of Serbia’s legal system, the indictment issued by Kosovo’s Special Prosecution against Milan Radoicic and others for the Banjska attack holds no significance.
In an interview with the Serbian state TV (RTS), Stefanovic recalled that Serbia’s territorial integrity, including Kosovo, is guaranteed by United Nations Security Council (UN SC) Resolution 1244. He emphasized that the institutions in Pristina have no jurisdiction to conduct any legal proceedings, including criminal ones.
He pointed out that Radoicic is currently under investigation by the Higher Public Prosecutor’s Office in Belgrade on suspicion of committing three criminal offenses along with several unidentified persons—“conspiracy to commit criminal acts,” “unauthorized production, possession, carrying, and trafficking of firearms and explosive materials,” and “serious offenses against public safety.”
“As part of the investigation, the Higher Public Prosecutor’s Office in Belgrade has reached out to EULEX through the Ministry of Justice, requesting the complete documentation related to the critical incident that occurred on September 24, 2023, in Banjska,” said the chief prosecutor noted.
He stressed that, to this day, no documentation has been provided to the prosecutor’s office, nor has any response been received from EULEX.
Radio Free Europe (RFE) reported Wednesday that the Kosovo authorities indicted 45 people over their alleged role in the 2023 Banjska attack by ethnic Serbs in which one Kosovo police officer and three Serbs were killed.
