Sar Mountains National Park employee wins case against Serbia in Strasbourg

The European Court of Human Rights on Tuesday delivered a judgment on the case “Boskocevic v. Serbia,” unanimously holding that there had been a violation of Article 34 of the European Convention on Human Rights, breaching the right of individual petition of a national park employee.

The applicant was an employee of the Sar Mountains National Park in Kosovo, who lodged an application with the European Court to complain about the non-enforcement of a judgment in his favor with regard to outstanding wages.

The case concerned his complaint that his managing director had sent him a letter warning him that he had breached his duties and risked dismissal shortly after he had lodged his application with the Court.

The Court found that the Serbian Government was responsible for the acts of the applicant’s employer and its managing director, said the press release.

The Court concluded that the warning letter had constituted “pressure” and “intimidation” and that that had interfered with the right of individual petition underpinning the Convention system, said the Council of Europe press release.
