Serbian Government adopts legislation to legalize unregistered properties

“The Government of the Republic of Serbia adopted at today’s session the Bill on Special Conditions for Recording and Registration of Rights to Real Estate, which systematically resolves the decades-old problem of the existence of a large number of unregistered and illegally built facilities,” the Serbian Government said in a press release on Friday.

This right will not be available to those who built in protected zones (nature, culture, waters, railway belt, motorway and expressway expropriation belt) and on land that is privately owned by another person, it said.
Facilities built in public areas, in national parks and protected zones, shall become the property of the Republic of Serbia ex lege, the press release noted.
The Government said that the adoption of this law ensures legal certainty for citizens who acquire ownership rights to a building and land, or the land under the building, if the conditions are met.

Real estate registration will be carried out using the latest digital technologies, through aerial photography, detection that enables the identification of buildings in a 3D model, the Serbian Government said.
